Steve, thanks for joining us today. Many people may not fully understand what probate is and why it might be necessary. Can you shed some light on that?

Probate is essentially a legal process that occurs after someone passes away. It involves validating their will (if they have one), identifying and inventorying their assets, paying off any debts and taxes owed by the estate, and ultimately distributing the remaining assets to their heirs or beneficiaries.

Not every estate goes through probate. Ordinarily, if the value of a person’s estate is below a certain threshold ($184,500 in California), it may be eligible for simplified procedures like a “small estate” affidavit.

Conversely, if the estate exceeds this limit or involves complex assets, full probate proceedings are usually necessary.

The Importance of Proper Asset Management

Steve, you mentioned that not all estates require probate. What are some common strategies people use to avoid probate altogether?

That’s a great question. Many individuals utilize estate planning tools like trusts to hold their assets. Assets held in a trust are typically not subject to probate because they pass directly to the beneficiaries named in the trust document.

Another way to avoid probate for certain assets is through joint tenancy. When two or more people own property jointly, upon the death of one owner, their share automatically passes to the surviving owner(s).

Challenges in Probate Administration: A Real-Life Example

Steve, you’ve been practicing probate law for many years. Are there any particular challenges you often encounter during this process?

Certainly. One issue I see quite frequently is when families disagree about the distribution of assets. Emotions can run high during these times, and it’s not uncommon for siblings or other relatives to have differing opinions on how the estate should be divided.

I recall one case where adult children were arguing over their deceased mother’s antique collection. It was a difficult situation that required careful mediation and compromise to reach a resolution that felt fair to all parties involved.

Notwithstanding these challenges, I find it incredibly rewarding to help families navigate the probate process during a difficult time.

According to the American Bar Association, approximately 2 million probate cases are filed in the United States each year. That underscores just how important it is for people to have a clear estate plan in place.
