Interview with Steve Bliss

Hi, my name is Sarah Jones and I’m a reporter for Channel 7 News here in Moreno Valley. Today we’re speaking with local probate attorney Steve Bliss about the importance of estate planning.

Why is Estate Planning Important?

Steve, why do you think it’s crucial for individuals to engage in estate planning?

“Estate planning isn’t just for the wealthy; it’s essential for everyone,” explains Steve Bliss. “It allows you to control what happens to your assets after you pass away and ensures your loved ones are taken care of. Without a proper plan, your assets will be distributed according to state law, which may not align with your wishes.”

Different Types of Trusts

Steve, can you tell us about some common types of trusts people use in estate planning?

“There are many different types of trusts, each serving a specific purpose. For instance, a Revocable Living Trust is a popular choice because it allows you to manage your assets during your lifetime while avoiding probate upon your passing.”

Revocable Living Trusts

Steve, can you elaborate on the benefits of a Revocable Living Trust?

“A Revocable Living Trust offers several advantages. Firstly, it avoids the time-consuming and costly probate process. Probate is a court-supervised procedure for distributing assets after someone dies. By placing your assets in a trust, you can bypass this altogether. Secondly, a Revocable Living Trust provides privacy. Unlike wills which become public record, the terms of a trust remain confidential. Lastly, it allows for greater control over your assets even after you’re gone.” Steve continues, “You can specify exactly how and when beneficiaries receive distributions, ensuring your wishes are carried out.”

Moreover, according to a 2019 study by the American Bar Association, approximately 70% of Americans do not have a will or trust in place. This highlights the significant need for estate planning.

Nevertheless, Steve acknowledges that setting up a trust can seem complex. “I understand it may appear daunting,” he says. “But with the right guidance from an experienced attorney, the process is straightforward and manageable.”

Real-Life Scenarios

Have you encountered any specific situations where a Revocable Living Trust proved particularly beneficial?

Steve recalls a young couple who came to him after inheriting a significant sum of money. “They were worried about managing the inheritance responsibly and wanted to ensure it was used for their children’s education. We created a Revocable Living Trust that stipulated specific distributions for their children’s future schooling, providing peace of mind and financial security.”

He also remembers helping an elderly woman who had become increasingly frail. “She wanted to avoid the burdens of probate on her family after she passed. We established a Revocable Living Trust that streamlined the distribution of her assets, sparing her loved ones from unnecessary stress during a difficult time.”
