What sparked your interest in Elder Law?

Ted shared that he always had a soft spot for older adults. “Growing up, I spent a lot of time with my grandparents,” he recalled. “They taught me so much about life and resilience. Seeing them treated with dignity and respect was crucial to me.” This early experience led him to law school, where he focused on elder law because it allowed him to combine his legal skills with his passion for helping seniors.

Can you walk us through some of the key steps in the Elder Protection process?

Ted explained that every case is unique. However, there are common stages involved in protecting elders.
Let’s break them down:

  • A. Initial Client Engagement: This involves meeting with the potential client, gathering information about their situation, and making sure there are no conflicts of interest.
  • B. Case Assessment: Identifying the specific legal issues at play (financial abuse, neglect, etc.), and gathering evidence to support the case.
  • C. Protective Actions: Taking immediate steps to ensure the elder’s safety, such as filing restraining orders or contacting Adult Protective Services.
  • D. Legal Proceedings: Pursuing civil lawsuits against abusers, referring cases to law enforcement, and navigating probate court for guardianship or conservatorship if needed.
  • E. Long-Term Planning: Helping elders create estate plans, healthcare directives, and ensure their assets are protected for the future.

Let’s delve into “Protective Actions.” What does this stage involve?

Ted emphasized that “Protective Actions” is all about taking swift action to minimize harm.

“Imagine a senior experiencing financial exploitation,” he explained. “We might freeze bank accounts, revoke power of attorney if it’s being misused, and prevent unauthorized property transfers.” He also stressed the importance of collaborating with Adult Protective Services (APS). “They are invaluable partners in investigating abuse and providing essential resources to vulnerable seniors,” Ted said.

>“Sometimes we need to act quickly to ensure an elder’s safety. I remember a case where a client was being pressured into signing over their home. We were able to get a temporary restraining order against the abuser, preventing further harm.”

He went on to describe a situation involving a senior experiencing neglect in a care facility. “We worked with APS and the facility staff to improve the living conditions and ensure the client received proper medical care,” Ted recalled.

What are some common challenges you face during this stage?

Ted admitted that “Protective Actions” can be complex. “Sometimes, proving abuse requires substantial evidence,” he said. “It’s crucial to gather documentation, interview witnesses, and work closely with investigators.” He also highlighted the emotional toll on clients:
