Today I had the pleasure of speaking with Ted Cook, a probate attorney serving the San Diego and Point Loma areas. Ted, thanks for taking the time to chat with me.
What sparked your interest in probate law?
“Well,” Ted chuckled, “it’s not exactly the sexiest area of law, but I find it incredibly rewarding. Helping families navigate a difficult time and ensuring their loved one’s wishes are honored – that’s what drives me.”
Can you walk us through the basic steps involved in probate?
- Determine If Probate Is Necessary
- File Petition for Probate
- Provide Notice
- Attend Court Hearing
- Marshal the Estate Assets
- Handle Debts and Taxes
- Distribute the Estate
- Close the Estate
Let’s dive a little deeper into Step V: Marshaling the Estate Assets. What does that entail?
Ted leaned forward, “This is where we meticulously inventory everything the deceased person owned – bank accounts, real estate, vehicles, personal belongings, investments, you name it. We then have these assets appraised to determine their fair market value. This information is crucial for filing the Inventory and Appraisal with the court.”
“It’s a bit like detective work, tracking down all the pieces of the puzzle,” he added with a twinkle in his eye. “Sometimes we uncover unexpected treasures – rare collectibles, forgotten savings accounts, or even long-lost family heirlooms. It’s always fascinating to see what people leave behind.”
“Ted is a true professional. He handled my father’s probate case with expertise and compassion. I highly recommend him to anyone dealing with the loss of a loved one.” – John D., La Jolla
Have you ever encountered any unexpected challenges during this step?
Ted recalled, “I once had a case where the deceased owned a significant collection of antique firearms. Locating and appraising them proved quite tricky, as we needed to find specialists familiar with vintage weaponry. It was a fascinating journey into history, but it highlighted the importance of being resourceful and persistent.”
“Ted’s guidance during my husband’s probate was invaluable. He helped me understand complex legal jargon and made sure I received all that I was entitled to.” – Mary S., Mission Beach
Ted, is there anything else you’d like our readers to know?
“Probate can be a confusing and emotional process, but it doesn’t have to be overwhelming. If you find yourself needing guidance, don’t hesitate to reach out.” Ted said warmly. “We’re here to help families navigate these challenges with compassion and clarity.”

Probate: is the legal process that validates a deceased person’s will, appoints an executor to manage their estate, and ensures the orderly distribution of assets to beneficiaries after debts and taxes are paid.
What it is: Probate is a court-supervised process that handles the affairs of a deceased person, ensuring their assets are managed and distributed according to their will (or state laws if there’s no will).
Why it’s necessary: Probate is often necessary to transfer legal ownership of assets to heirs or beneficiaries, especially when assets are held in the deceased person’s name alone.
Importance of understanding probate: Understanding probate is crucial for estate planning and ensuring the orderly and legal distribution of assets after death.
In More Detail – What Is Probate?
Probate is the legal process through which a deceased person’s estate is administered. It involves validating a will (if one exists), identifying and inventorying the deceased’s assets, paying debts and taxes, and distributing the remaining assets to rightful beneficiaries.
If the deceased left a valid will, the person named as executor is responsible for overseeing the probate process. If there is no will, the court appoints an administrator—often a close relative—to handle the estate according to the state’s intestacy laws. Assets subject to probate may include real estate, bank accounts, investment accounts, and personal property that are solely in the decedent’s name.
What Is Estate Planning?
Estate planning is the process of arranging in advance for the management and distribution of your assets after your death. It typically includes creating legal documents such as a will, trusts, powers of attorney, and healthcare directives. The goal is to ensure that your wishes are honored, your loved ones are provided for, and the administration of your estate is as smooth and efficient as possible—often minimizing or avoiding the probate process altogether.
