I’m sitting down today with Ted Cook, an elder protection attorney here in sunny San Diego. Ted, thanks for taking the time to chat with me.
What Exactly is Elder Protection?
“Elder protection” is a broad term. Essentially, it’s about safeguarding seniors from abuse, exploitation, and neglect. We see everything from financial scams targeting vulnerable individuals to physical or emotional abuse within families. My role is to advocate for these seniors, ensuring their rights are protected and they have the support they need.
What Are the Key Steps in the Elder Protection Process?
Ted outlines a comprehensive process with six distinct steps:
- A. Initial Client Engagement
- B. Case Assessment
- C. Protective Actions
- D. Legal Proceedings
- E. Long-Term Planning
- F. Case Resolution & Follow-Up
Let’s Dive into ‘Protective Actions.’ Can You Elaborate on that Step?
Ted nods enthusiastically.
“Protective actions are often the most critical part of elder protection cases,” Ted explains. “This stage is all about immediate intervention to stop ongoing harm.”
“We might need to file for a restraining order against an abusive caregiver, notify Adult Protective Services (APS) about suspected neglect, or even petition the court for guardianship or conservatorship if someone lacks the capacity to make their own decisions. Every situation is unique, and our actions are tailored to address the specific threats facing the senior.”
“Imagine a scenario where an elderly individual is being financially exploited by a family member. We might need to freeze bank accounts, prevent unauthorized property transfers, and even initiate power of attorney revocation or enforcement to regain control over their assets,” Ted adds.
He emphasizes the importance of swift action: “The longer abuse continues, the more devastating the consequences can be.”
Have You Encountered Any Challenges in Taking ‘Protective Actions’?
Ted leans back thoughtfully.
“One case that stands out involved a woman whose son was systematically draining her bank accounts. By the time she reached out, he’d already transferred tens of thousands of dollars. Getting those funds back proved incredibly difficult – a stark reminder that prevention is always better than cure.”
“Another challenge arises when dealing with seniors who are cognitively impaired. They may not fully understand the extent of the abuse or be able to articulate their needs clearly, making it crucial to gather evidence from other sources and advocate on their behalf”
