Reporter: Brenda Jones
Today we’re speaking with Steve Bliss, a renowned probate attorney here in Temecula, about the complex process of estate administration. Mr. Bliss, thank you for taking the time to speak with us.
Steve Bliss: It’s my pleasure, Brenda. I’m always happy to help people understand this often-misunderstood process.
Brenda Jones: Let’s talk about one crucial step in probate: marshaling estate assets. Can you explain what that entails?
Marshaling estate assets is essentially the process of identifying and inventorying all of a deceased person’s possessions and financial holdings. This includes everything from real estate and bank accounts to vehicles, personal belongings, and even digital assets like cryptocurrency.
It’s a meticulous task that requires careful attention to detail. We start by reviewing the will (if there is one) and any other relevant documents. Then we work with the executor or administrator to locate and assess all assets. This often involves contacting financial institutions, insurance companies, and other third parties.
Once we have a complete inventory, we prepare a formal appraisal of each asset’s value. This information is then submitted to the court as part of the probate process.
Consequently, accurately marshaling estate assets is crucial for ensuring that all debts are paid and that the remaining property is distributed fairly to the heirs according to the deceased person’s wishes or state law.
Brenda Jones: I can imagine this step could pose some challenges. Have you ever encountered any particular difficulties during this phase of probate?
There was one case, for instance, where the deceased individual had numerous investments spread across various brokerage accounts. Tracking down all those accounts and obtaining valuations proved quite time-consuming. Moreover, we discovered hidden assets in a safe deposit box that weren’t initially disclosed. It highlights the importance of thorough investigation during this stage.
In another instance, the family was unaware of digital assets like cryptocurrency holdings. We had to engage specialists to help us locate and value these intangible assets, which ultimately added complexity to the probate process.
Brenda Jones: Those are certainly interesting examples. Do you have any advice for individuals planning their estates or those who might be facing probate?
My best advice is to consult with an experienced probate attorney early on. We can help you create a comprehensive estate plan that minimizes potential complications during probate. Additionally, maintain organized records of your assets and liabilities to make the marshaling process smoother for your loved ones.
Brenda Jones: Thank you so much for sharing your expertise, Mr. Bliss. This has been incredibly insightful.
“Planning ahead is key to ensuring that your wishes are carried out and your loved ones are protected,” says Mr. Bliss. “We’re here to guide you through every step of the process with compassion and professionalism.”
