Certainly. One crucial step is selecting an executor or trustee. This individual will be responsible for managing your estate after your passing. Consequently, it’s essential to choose someone trustworthy, capable, and willing to take on this significant responsibility.
Think about who possesses strong organizational skills, good judgment, and the ability to handle financial matters responsibly. Moreover, they should be someone you trust implicitly to carry out your wishes as outlined in your will or trust.
Notwithstanding these qualities, it’s important to remember that executors are not required to be legal experts. However, they may benefit from seeking professional guidance from an estate planning attorney or financial advisor during the probate process.
According to a study by Caring.com, approximately 70% of Americans do not have a will or trust in place. This highlights the importance of proactive estate planning and selecting a reliable executor who can ensure your assets are distributed according to your wishes.
I recall one instance where a client named his brother as executor, assuming he was the most logical choice. However, it turned out that the brother was struggling financially and lacked the organizational skills necessary for managing a complex estate.
