Interview with Steve Bliss, San Diego Probate Attorney

Meeting Steve

Hello everyone, I’m Brenda Sanchez reporting live from sunny San Diego. Today, we have the pleasure of interviewing Mr. Steve Bliss, a renowned probate attorney here in our beautiful city. Mr. Bliss, thank you for joining us.

Discussing Probate: Step III – Providing Notice

Mr. Bliss, could you shed some light on one of the key steps in the probate process?

Certainly, Brenda. One crucial step is providing notice to all interested parties. This involves publishing a notice in a local newspaper for three consecutive weeks. We also meticulously mail notices to all identified heirs and beneficiaries, ensuring everyone who has a legal claim receives information about the estate.

Moreover, we diligently notify known creditors using Form DE-157. This step is vital for transparency and fairness, allowing potential claimants to come forward and present their cases. Consequently, it helps prevent any unforeseen disputes or complications down the road.

It’s worth noting that about 20% of probate cases involve some level of creditor claims (Source: California Courts). Failing to properly notify creditors could lead to delays, legal challenges, and even financial liability for the executor.

There was one instance where a family member discovered an outstanding debt owed to a distant relative shortly before distribution. Thanks to our thorough notice process, we were able to locate the creditor and resolve the issue amicably, ultimately preventing what could have been a lengthy and costly dispute.
